Conveyancing

Conveyancing is the legal process of preparing and managing the documents required to transfer property ownership. It involves drafting and reviewing legal documents, conducting property searches, managing financial transactions, and ensuring the property is properly registered with the appropriate authorities.

Steps involved in Purchasing a Home

Once your Contract of Purchase and Sale has been accepted and all subject clauses have been removed, it’s time to involve us as your Notary.

To begin, your realtor will need to forward a copy of your Contract to our office. If you are securing financing, please inform your lender or mortgage representative that our office will be handling your purchase so they can send us the mortgage instructions.
We will then contact you to collect necessary personal details, including how you wish to hold title to the property. Our team will prepare all required documents and schedule an appointment for you to sign them, typically 1–3 business days before the completion date.

Prior to your appointment, we will send you copies of all the documents for your review. This allows you to familiarize yourself with the paperwork in advance. However, we will go over everything with you in detail during your appointment to ensure you fully understand each document. We will also provide you with the final amount required to complete the purchase, which must be paid via bank draft.
On the completion date, the property will be registered in your name, and funds will be transferred to the seller’s legal representative. Once everything is finalized, we will notify both you and your realtor, ensuring all is set for possession day, when your realtor will arrange the key exchange.

Steps involved in Selling a Home

Please contact our office once all conditions of your Contract of Purchase and Sale have been satisfied. We typically begin processing your file a few weeks before the scheduled closing date. Be sure to provide your realtor with our contact information so they can forward us the necessary documents. Once received, we’ll open your file and begin preparing for the next steps.

We will schedule your signing appointment approximately 1–3 business days prior to the closing date. During this meeting, we’ll walk you through each document, answering any questions you may have to ensure everything is clear and understood.

On the closing day, we will pay off any existing mortgage, line of credit, or other financial charges registered on the title, if applicable. The remaining sale proceeds will be disbursed to you by notary trust cheque.

If applicable, we will also confirm that your lender has discharged the mortgage/line of credit from the title in due course.

There are several scenarios in which a person may be added to or removed from a property title. Below are some of the common types of title transfers we regularly handle:

If you've legally changed your name due to marriage, divorce, or other reasons since purchasing your property, we can update the title with the Land Title Office. We also assist with address changes or corrections to ensure your title information remains accurate.

Manufactured (Mobile) Home Transactions

We prepare all necessary documents for the purchase or sale of manufactured (mobile) homes. This includes transferring ownership through the Manufactured Home Registry, registering or discharging PPSA interests, and ensuring there are no outstanding liens or title issues.
